Oregon Trial and Transaction Attorney

Welcome to my website. I am George L. Derr, Attorney at Law, a trial attorney in Eugene, Oregon. I represent clients in a variety of adversarial proceedings including:

Civil Litigation

During the last twenty-three years, I have represented clients in a wide variety of civil matters, providing litigation services to both plaintiffs and defendants. My experience includes: business disputes, commercial litigation, breach of contract, fraud and misrepresentation, real estate disputes, and claims involving trade contractors and builders, and breach of fiduciary duties.

Domestic Relations

I have an extensive domestic relations practice which includes: representing clients in divorce and legal separation proceedings, child custody matters, including modification and enforcement of parenting time, Family Abuse Prevention Act and Stalking Restraining Orders and Contempt proceedings.

Criminal Defense

I provide defense representation of clients against all felony, misdemeanor, and traffic violation charges.

Felonies: I provide legal services for clients who have been charged with felonies. I handle most felonies, including robbery, drug offenses, murder, and arson. I am an experienced criminal defense attorney and a former prosecutor with prior law enforcement experience. I can help you fight back against any felony criminal charges and will zealously defend your rights.

Misdemeanors: I also provide my clients with experienced legal defense in misdemeanor matters, such as assault, harassment, disorderly conduct, theft, violation of stalking and restraining orders. Misdemeanor charges can have serious consequences to your life, and I can protect your rights under the law and ensure that you get a fair trial and quality representation.

Traffic Violations: Traffic violations can have implications in many areas of your life. There can be fines, insurance rate hikes, and even a loss of your license or employment in certain cases. If you have gotten a traffic ticket for speeding, running a stop sign, or have been arrested or cited for driving under the influence of intoxicants (DUII) I can help you fight the ticket and minimize any potential adverse consequences.

Expunction: I help client’s clean up their criminal history and record of convictions. This can be very important when old convictions still haunt you and adversely affect your employment.

Firearms: My office helps people reinstate their right to possess firearms. Many people with dated convictions can, and do, get their right to lawfully possess firearms restored through various legal avenues, despite their criminal histories.

Personal Injury and Wrongful Death

Some of the most important services I provide is to help people who have been injured because of another person’s fault. These type case can include:

    • Car Accidents
    • Trucking accidents
    • Motorcycle accidents
    • Drunk driving accidents
    • Bicycle or Pedestrian Accidents
    • Wrongful Death

I can help you to recover the compensation for your losses that the law and the circumstances of your case will allow. I provide free initial consultations on all personal injury and wrongful death cases.

Appeal

I perform all levels of appeals in Oregon State Courts. If you need to have an appeal taken from an adverse trial court, jury or administrative judge ruling, or the “other side” has filed an appeal and you need to respond, I can help you. I typically help clients make an informed decision as to whether to file an appeal or respond to an appeal that has been filed. Determining whether an appeal is a good decision or whether there is some other means to correct the problem, such as post-trial, pre-appeal mediation or negotiated resolution, is an important consideration that needs to be made with the assistance of experienced legal counsel.

Real Estate and Business Transactions

In addition to my trial practice, I also have a substantial transactional practice in real estate and business:

I assist clients in negotiating the sale, purchase and lease of residential, agricultural, and commercial and industrial real estate. This includes the drafting and preparation of mortgages, trust deeds, promissory notes, easements, rental agreements, leases, rental agreements and related documents.

I also form various business organizations including corporations, limited liability companies, partnerships and sole proprietorships and negotiate business contracts and other transactions.

Arbitration and Mediation

Because of the broad range of experience I have, I also provide arbitration and mediation services. I serve as an arbitrator of domestic relation matters (i.e. divorce, child custody, parenting time), construction law cases, property personal injury claims, breach of contract and real estate disputes. I mediate domestic relations and other potentially adversarial civil claims.

Attorney Representation

Because of my extensive experience as an attorney I also represent other attorneys facing disciplinary matters before the Oregon State Bar association. If you are an attorney under investigation for any violation of the Rules of Professional Conduct, please do not hesitate to contact me, directly.

Work Philosophy

I take great pride in being openly candid and honest with my clients in all matters. I believe that by being entirely straightforward with my clients and by fully explaining the law and all available options and opportunities to my clients, together we can effectively move forward towards achieving their goals. I enjoy thinking “outside the box” and arriving at creative solutions to difficult problems or goals facing my clients.

Typically, I work with my clients to identify what their legal goals, problems and issues are, what their various options and potential resolutions and outcomes may be, and then let them decide which course they wish to pursue. My clients appreciate this style of representation as it allows them to be a part of the decision making process and affords them substantial control over their case. This, in turn, helps foster a healthy attorney-client relationship.

For the convenience of my clients and legal counsel, I try to be available when the client is. I keep flexible office hours and make myself available on some weekend hours by appointment.

For cost-effective legal assistance from an experienced trial attorney who can help you make informed decisions and get you the results you deserve, or to simply help solve a legal dispute through mediation or arbitration, please contact me, George L.
